The Allocation of Recreation and Park Resources: The Courts' Intervention

Abstract

On a number of occasions, the U.S. Court System has been asked to examine the equitability of urban park and recreation service delivery patterns. The paper provides a review of five court cases and offers managers suggestions on how to avoid unfavorable litigation. Conclusions drawn from these case studies indicate that an agency should maintain adequate records of service distribution and set policy to ensure an equitable allocation of resources across the jurisdiction. It also suggests that new litigation will occur as the profession develops better measures of the benefits of leisure services.?
